These Terms of Service govern your use of the Leandri Vermaak Art website and purchases made through the store.

Leandri Vermaak Art is operated under Vermaak Creative in South Africa.

By accessing the website or placing an order, you agree to these Terms together with our Returns and Refund Policy, Shipping Policy and Privacy Policy.

Nothing in these Terms limits rights that cannot legally be excluded under applicable law.

1. Online Store

You may use this website only for lawful purposes.

You must not misuse the website, interfere with its operation, attempt unauthorised access to its systems or use the website in a way that violates applicable law or the rights of another person.

2. Products

We sell products that may include:

Original artwork
Art prints
Canvas prints
Printed art products
Print-on-demand products
Commissioned artwork
Personalised products
Digital products
Other art-related products

Product availability can vary by country or region.

We reserve the right to discontinue products or change our product range.

3. Product Images and Colour

We make reasonable efforts to represent products and artwork accurately.

Colours can display differently depending on your device, screen settings, lighting and production method.

Printed products may vary slightly from the image displayed on screen.

Original and handmade artwork may contain natural variations associated with handmade work.

Minor differences that are inherent in printing, materials or handmade production are not necessarily defects.

Nothing in this clause limits your rights if a product is materially different from its description or does not meet standards required by applicable law.

4. Product Dimensions

Dimensions and sizing information are provided on product listings where applicable.

Small manufacturing tolerances may occur in printed or manufactured products.

Customers should check dimensions before ordering.

5. Prices

Prices displayed on the website apply at the time the order is placed, subject to correction of genuine errors as permitted by law.

The currency displayed may depend on your location or Shopify market settings.

Shipping charges, taxes or duties will be shown separately where applicable.

International customers may also be responsible for customs charges as explained in our Shipping Policy.

6. Orders

Placing an order constitutes an offer to purchase the selected products.

An order is subject to acceptance, availability, successful payment and any fraud or security checks that may reasonably be required.

You will have an opportunity to review your order information before completing checkout.

If we cannot fulfil an accepted order, we will notify you and provide any refund required by law.

7. Incorrect Pricing or Information

We make reasonable efforts to keep website information accurate.

If a genuine pricing, description or technical error occurs, we may correct it.

Any cancellation or adjustment resulting from an error will be handled in accordance with applicable law.

8. Payments

Payments are processed using payment providers made available through our Shopify store.

We do not ordinarily receive or store your complete payment-card details ourselves.

Payment providers may process your personal information in accordance with their own terms and privacy policies.

9. Third-Party Fulfilment

Some products are manufactured, printed or shipped by third-party suppliers and fulfilment partners.

These may include local South African suppliers as well as international fulfilment networks such as Printify and Gelato.

By ordering a product that requires third-party fulfilment, you acknowledge that the information reasonably required to manufacture and deliver your order may be provided to the relevant fulfilment and delivery partners.

10. Commissioned Artwork

Commissioned artwork is created specifically for the customer.

A 50% deposit is normally required before work begins unless another arrangement is agreed in writing.

The scope, subject matter, dimensions, price, estimated timeframe, creative direction and any specific approval stages may be agreed separately for each commission.

Unless expressly agreed otherwise, the customer provides inspiration and reference material while Leandri Vermaak retains artistic discretion over the final work.

Reasonable differences between reference material and the completed artwork are an inherent part of an artist-created commission and do not necessarily constitute a defect.

If a customer requests a material change outside the agreed scope after work has begun, additional charges or time may be required.

11. Customer-Supplied Reference Material

Where you provide photographs, images, artwork or other reference material for a commission, you confirm that you have the right to provide that material to us and to authorise its use for the agreed commission.

You must not knowingly provide material that infringes another person's copyright, privacy or other rights.

12. Copyright and Intellectual Property

Unless expressly stated otherwise, all original artwork, designs, photographs, website graphics, written material and other creative content created by Leandri Vermaak remain protected by applicable copyright and intellectual property law.

Purchasing an original artwork, print or other product transfers ownership of the physical product only.

It does not transfer copyright, reproduction rights, commercial licensing rights or intellectual property rights in the artwork.

You may not reproduce, copy, scan, distribute, manufacture products from, sell reproductions of, commercially exploit or create derivative commercial products from our artwork without prior written permission.

Images of artwork displayed on the website may not be used commercially without permission.

Licensing rights must be agreed separately in writing.

13. Personal Use of Purchased Products

Unless a commercial licence has been separately granted, products and digital content are supplied for personal use only.

You may resell a lawfully purchased physical original or physical product where the law permits, but such resale does not transfer copyright or reproduction rights.

14. Digital Products

Digital products are licensed rather than sold outright in respect of the underlying intellectual property.

Unless the individual product licence expressly states otherwise, digital products may not be reproduced for resale, redistributed, shared commercially or used to manufacture products for sale.

15. Reviews and Communications

If you voluntarily submit a review, testimonial or feedback, you confirm that your submission is truthful and does not infringe another person's rights.

We will not publish private customer communications as testimonials without appropriate permission.

16. Third-Party Links and Services

The website may contain links to or integrations with third-party services.

We are not responsible for the content, availability, terms or privacy practices of third-party websites that we do not control.

17. Returns, Refunds and Cancellations

Returns, refunds and cancellations are governed by our Returns and Refund Policy and applicable law.

18. Shipping and Delivery

Shipping, delivery, customs and fulfilment are governed by our Shipping Policy.

19. Privacy

Our processing of personal information is described in our Privacy Policy.

20. Availability of the Website

We do not guarantee that the website will always be uninterrupted or error-free.

We may temporarily suspend or change website functionality for maintenance, security or operational reasons.

21. Liability

To the maximum extent permitted by law, Leandri Vermaak Art will not be liable for indirect or consequential losses arising solely from circumstances beyond our reasonable control.

Nothing in these Terms excludes or limits liability or consumer remedies that cannot legally be excluded or limited.

These Terms are governed by the laws of the Republic of South Africa to the extent permitted by applicable law.

If you are a consumer in another jurisdiction, this clause does not deprive you of mandatory consumer protections that apply to you under the law of your country or region.
